HB11-1050 Boiler Inspection Regulation 
Short Title: Boiler Inspection Regulation
Summary: The definition of "director" is changed from chief boiler inspector to the director of the division of oil and public safety (division) and conforming amendments are made throughout the article. The bill makes all inspection certificates valid for the period specified on the face of the certificate. Changes are also made to the way that inspection fees may be collected on a pro rata basis. Current law allows the division to prorate annual boiler inspection fees on a quarterly basis. The bill allows the division to prorate the boiler inspection fees based on the percentage of each period of a certificate term. The change will accommodate certificate terms that are longer than one year.

SB11-157 Modifications To School Finance Act 
Short Title: Modifications To School Finance Act
Summary: 2010-11 budget balancing bill. The bill makes several changes to the "Public School Finance Act of 1994" (act) and to the funding for the act. Supplemental kindergarten enrollment funding. Currently, school districts receive supplemental kindergarten enrollment funding, which is required to be used in furtherance of providing a full-day kindergarten program. For the 2008-09 and 2009-10 budget years, the law specifies that the amount of supplemental kindergarten enrollment funding is equal to 8% of a full-day pupil multiplied by the number of students who are enrolled in kindergarten for the applicable budget year, but does not specify the percentage to be used in such calculation for any of the following budget years. The bill specifies that, for the 2010-11 budget year and each budget year thereafter, the percentage to be used in the calculation of supplemental kindergarten enrollment funding is 8%. Mid-year adjustments to budget stabilization factor. In 2010, the general assembly added a provision to the act that affected the 2010-11 and 2011-12 budget years. The provision reduced total program funding for all school districts and institute charter schools through the application of a state budget stabilization factor and requires the department of education (department) and the staff of the legislative council to recalculate the factor mid-year based on actual pupil enrollment and local tax revenues. The bill amends this provision to clarify that the general assembly's intent was to maintain total program funding at the level established for the applicable budget year. Effect of refinance with federal moneys on other allocations. For the 2010-11 budget year, 2 sources of federal moneys totaling approximately $216 million will be made available to school districts and will be allocated to districts by the department based on the school finance formula specified in the act. The bill reduces the state's share of total program funding for the 2010-11 budget year by such amount, which will reduce districts' per pupil revenues distributed through the act. The bill specifies the general assembly's intent that various distributions and allocations that are tied to per pupil revenues, as well as the calculation of the buyout of categorical programs for affected districts, be calculated as if the state's share of total program funding was not reduced. Districts are held harmless in making such calculations due to the availability of the federal moneys. The bill adjusts appropriations to both the department of education and the department of higher education for the 2010-11 fiscal year to reflect the availability of federal moneys.

Summary: 2010-11 Budget Balancing Bill. With the exception of fees allocated to the newborn screening and genetic counseling cash funds, fees collected by the department of public health and environment in connection with the operation of its laboratories are currently not deposited in a cash fund. This prevents the department from accumulating these revenues and thereby increases the cost to finance the acquisition of expensive laboratory equipment. By creating a laboratory cash fund in which unencumbered revenues will accumulate, the bill reduces the department's acquisition costs.

SB11-163 Repeal Alternative Fuels Rebate Program 
Short Title: Repeal Alternative Fuels Rebate Program
Summary: 2010-11 budget balancing bill. The bill repeals the alternative fuels rebate program that allows the executive director of the department of revenue (executive director) to award rebates, up to a certain aggregate total, for alternative fuel motor vehicles owned, titled, and registered in the state that are used in connection with the business or official activities of certain state and local governmental entities and certain tax-exempt nongovernmental entities. Currently, the program specifies the types of alternative fuel vehicles and conversions of vehicles related to alternative fuel usage that qualify for the rebate and the amount of the rebate the executive director may award. The bill also requires any remaining moneys in the alternative fuels rebate fund to be transferred to the general fund. The bill does not affect the income tax credit available for the purchase of vehicles using alternative fuels.
