26 Amend printed bill, page 3, strike lines 9 through 12 and substitute:

28 "(a) "FIRST-GENERATION-SERVING INSTITUTION" MEANS A STATE
29 INSTITUTION OF HIGHER EDUCATION:
30 (I) WHOSE RESIDENT FIRST-GENERATION UNDERGRADUATE
31 STUDENT POPULATION SHARE, AS DEFINED IN SECTION 23-18-302, FOR
32 THREE CONSECUTIVE YEARS, INCLUDING THE CURRENT YEAR, IS EQUAL TO
33 OR HIGHER THAN THE PERCENTAGE ESTABLISHED BY THE COLORADO
34 COMMISSION ON HIGHER EDUCATION, WHICH PERCENTAGE MUST NOT BE
35 LESS THAN THE STATEWIDE PERCENTAGE OF RESIDENT FIRST-GENERATION
36 UNDERGRADUATE STUDENTS IN ALL STATE INSTITUTIONS OF HIGHER
37 EDUCATION; AND
38 (II) THAT MEETS OTHER METRICS, INCLUDING RETENTION AND
39 COMPLETION RATES, AS ESTABLISHED BY THE COLORADO COMMISSION ON
40 HIGHER EDUCATION IN COLLABORATION WITH STATE INSTITUTIONS OF
41 HIGHER EDUCATION.".

10 takes effect at 12:01 a.m. on the day following the expiration of the
11 ninety-day period after final adjournment of the general assembly; except
12 that, if a referendum petition is filed pursuant to section 1 (3) of article V
13 of the state constitution against this act or an item, section, or part of this
14 act within such period, then the act, item, section, or part will not take
15 effect unless approved by the people at the general election to be held in
16 November 2024 and, in such case, will take effect on the date of the
17 official declaration of the vote thereon by the governor.".
