26 (a) The cash funds appropriation from the state public school fund
27 created in section 22-54-114 (1), C.R.S., estimated to be from interest and
28 income earned on the investment of money in the public school fund that
102 29 is credited to the state public school fund pursuant to section 22-41-
30 (3)(h), C.R.S., for the state share of districts' total program funding is
31 decreased by $5,000,000; and
32 (b) The cash funds appropriation from the state public school fund
33 created in section 22-54-114 (1) C.R.S., from interest and income earned
34 on the investment of money in the public school fund that is credited to
35 the state public school fund pursuant to section 22-41-102 (3)(h), C.R.S.,
36 for at-risk per pupil additional funding is decreased by $5,000,000.
37 (2) For the 2024-25 state fiscal year, $10,000,000 is appropriated
38 to the department of education. This appropriation is from the state
39 education fund created in section 17 (4)(a) of article IX of the state
40 constitution. To implement this act, the department may use this
41 appropriation as follows:
42 (a) $5,000,000 for the state share of districts' total program
43 funding; and
44 (b) $5,000,000 for at-risk per pupil additional funding.
45 SECTION 70. Appropriation. (1) For the 2024-25 state fiscal
46 year, $32,875 is appropriated to the legislative department. This
47 appropriation is from the general fund. To implement this act, the
48 department may use this appropriation as follows:
49 (a) $2,359 for use by the general assembly;
50 (b) $22,047 for use by the legislative council, which amount is
51 based on an assumption that the legislative council will require an
52 additional 0.3 FTE; and

DISTRICT'S ASSESSED VALUE OF REAL PROPERTY FOR THE PROPERTY TAX YEAR
COMMENCING ON JANUARY 1, 2023 DIVIDED BY THE DISTRICT'S PUPIL
ENROLLMENT DIVIDED BY TWO THOUSAND; AND
(II) DETERMINE THE MEDIAN AMOUNT OF ALL CALCULATIONS MADE
PURSUANT TO SUBSECTION (3.5)(a)(I) OF THIS SECTION.
(b) FOR EACH DISTRICT, THE DEPARTMENT SHALL DETERMINE IF:
(I) THE DISTRICT'S AMOUNT CALCULATED PURSUANT TO SUBSECTION
(3.5)(a)(I) OF THIS SECTION IS LESS THAN THE AMOUNT DETERMINED PURSUANT
TO SUBSECTION (3.5)(a)(II) OF THIS SECTION;
(II) THE NUMBER OF MILLS THE DISTRICT IS AUTHORIZED BY ITS
ELIGIBLE ELECTORS TO LEVY PURSUANT TO SECTION 22-54-108 IS GREATER
THAN ZERO; AND
(III) THE DISTRICT HAS AN AMOUNT THAT IS GREATER THAN 0.9 AFTER
CALCULATING THE MAXIMUM NUMBER OF MILLS THE DISTRICT IS AUTHORIZED
TO LEVY PURSUANT TO SECTION 22-54-108 (3)(b)(V) MINUS THE NUMBER OF
MILLS THE DISTRICT IS AUTHORIZED BY ITS ELIGIBLE ELECTORS TO LEVY
PURSUANT TO SECTION 22-54-108.
(c) FOR EACH DISTRICT THAT SATISFIES EVERY CONDITION DESCRIBED
PURSUANT TO SUBSECTION (3.5)(b) OF THIS SECTION, THE DEPARTMENT SHALL
CALCULATE FOR EACH DISTRICT AN AMOUNT EQUAL TO:
(MEDIAN AMOUNT DETERMINED PURSUANT TO SUBSECTION (3.5)(a)(II)
OF THIS SECTION - DISTRICT AMOUNT CALCULATED PURSUANT TO
SUBSECTION (3.5)(a)(I) OF THIS SECTION) X DISTRICT'S PUPIL
ENROLLMENT.
(d) NOTWITHSTANDING ANY PROVISION OF THIS SECTION, FOR THE
2023-24 BUDGET YEAR, EACH DISTRICT MUST RECEIVE THE GREATER OF THE
AMOUNT DETERMINED PURSUANT TO SUBSECTION (3.5)(c) OF THIS SECTION OR
THE AMOUNT DETERMINED PURSUANT TO SUBSECTION (3) OF THIS SECTION.
(e) NO LATER THAN JUNE 10, 2024, THE STATE TREASURER SHALL
TRANSFER NINE MILLION ONE HUNDRED THIRTY-FIVE THOUSAND SIX HUNDRED
NINETY-EIGHT DOLLARS ($9,135,698) FROM THE STATE EDUCATION FUND TO
THE MILL LEVY OVERRIDE MATCH FUND.".

"(b) (I) "Total program", on and after July 1, 2023, BUT PRIOR TO JULY
1, 2025, means a district's or small rural district's total program calculated
