37 Amend printed bill, page 19, strike lines 1 through 9 and substitute:

39 "SECTION 9. Act subject to petition - effective date -
40 applicability. (1) This act takes effect at 12:01 a.m. on the day following
41 the expiration of the ninety-day period after final adjournment of the
42 general assembly; except that, if a referendum petition is filed pursuant
43 to section 1 (3) of article V of the state constitution against this act or an
44 item, section, or part of this act within such period, then the act, item,
45 section, or part will not take effect unless approved by the people at the
46 general election to be held in November 2026 and, in such case, will take
47 effect on the date of the official declaration of the vote thereon by the
48 governor.
49 (2) This act applies to well permit applications that are pending
50 before, on, or after the applicable effective date of this act and to valid
51 well permits in existence before, on, or after the applicable effective date
52 of this act.".
