Amendments for SB21-021

After consideration on the merits, the Committee recommends that SB21-021 be amended
as follows, and as so amended, be referred to the Committee of the Whole with favorable
recommendation and with a recommendation that it be placed on the Consent Calendar.
Amend printed bill, page 39, after line 16 insert:

"SECTION 4. Appropriation. (1) For the 2021-22 state fiscal
year, $108,432 is appropriated to the department of regulatory agencies.
This appropriation is from the division of professions and occupations
cash fund created in section 12-20-105 (3), C.R.S. To implement this act,
the division may use this appropriation as follows:
(a) $14,418 for use by the division of professions and occupations
for personal services, which amount is based on an assumption that the
department will require an additional 0.3 FTE;
(b) $17,000 for use by the division of professions and
occupations for operating expenses;
(c) $17,014 for the purchase of legal services; and
(d) $60,000 for the purchase of information technology services.
(2) For the 2021-22 state fiscal year, $17,014 is appropriated to
the department of law. This appropriation is from reappropriated funds
received from the department of regulatory agencies under subsection
(1)(c) of this section and is based on an assumption that the department
of law will require an additional 0.1 FTE. To implement this act, the
department of law may use this appropriation to provide legal services
for the department of regulatory agencies.
(3) For the 2021-22 state fiscal year, $60,000 is appropriated to
the office of the governor for use by the office of information
technology. This appropriation is from reappropriated funds received
from the department of regulatory agencies under subsection (1)(d) of
this section. To implement this act, the office may use this appropriation
to provide information technology services for the department of
regulatory agencies.
(4) For the 2021-22 state fiscal year, $21,503 is appropriated to
the department of public safety for use by the Colorado bureau of
investigation. This appropriation is from the Colorado bureau of
investigation identification unit cash fund created in section 24-33.5-
426, C.R.S. To implement this act, the department may use this
appropriation as follows:
(a) $6,251 for use by the biometric identification and records unit
for personal services, which amount is based on an assumption that the
unit will require an additional 0.1 FTE;
(b) $15,252 for use by the biometric identification and records
unit for operating expenses.".

43 SUBMITTED TO THE COLORADO BUREAU OF INVESTIGATION. UPON RECEIPT
1 OF FINGERPRINTS AND RECEIPT OF THE PAYMENT FOR COSTS, THE
2 COLORADO BUREAU OF INVESTIGATION SHALL CONDUCT A STATE AND
3 NATIONAL FINGERPRINT-BASED CRIMINAL HISTORY RECORD CHECK
4 UTILIZING RECORDS OF THE COLORADO BUREAU OF INVESTIGATION AND
5 THE FEDERAL BUREAU OF INVESTIGATION AND SHALL FORWARD THE
6 RESULTS OF THE CRIMINAL HISTORY RECORD CHECK TO THE BOARD. THE
7 BOARD SHALL USE THE INFORMATION RESULTING FROM THE
8 FINGERPRINT-BASED CRIMINAL HISTORY RECORD CHECK TO INVESTIGATE
9 AND DETERMINE WHETHER AN APPLICANT IS QUALIFIED TO HOLD A
10 LICENSE PURSUANT TO THE COMPACT. THE BOARD MAY VERIFY THE
11 INFORMATION AN APPLICANT IS REQUIRED TO SUBMIT. THE RESULTS OF
12 THE CRIMINAL HISTORY RECORD CHECK ARE CONFIDENTIAL. THE BOARD
13 SHALL NOT RELEASE THE RESULTS TO THE PUBLIC, THE COMMISSION, OR
102 14 ANY OTHER REGULATOR, AS THAT TERM IS DEFINED IN SECTION 12-20-
15 (14).".
