27 Amend reengrossed bill, page 3, before line 1 insert:
28 "SECTION 1. In Colorado Revised Statutes, 31-25-805, amend
29 (1) and (2)(a) as follows:
30 31-25-805. Board - membership - term of office. (1) The affairs
31 of the authority shall be under the direct supervision and control of a
32 board consisting of not less than five nor more than eleven members
33 appointed by the governing body; EXCEPT THAT FOR ANY TWENTY-YEAR
34 EXTENSION PERIOD PURSUANT TO SECTION 31-25-807 (3)(a)(V), THE
35 AFFAIRS OF THE AUTHORITY SHALL BE UNDER THE DIRECT SUPERVISION
36 AND CONTROL OF A BOARD CONSISTING OF NOT LESS THAN NINE AND NO
37 MORE THAN THIRTEEN MEMBERS, WITH TWO MEMBERS APPOINTED BY THE
38 ENTITIES IDENTIFIED IN SUBSECTION (2)(a)(II) OF THIS SECTION AND ALL
39 REMAINING MEMBERS APPOINTED BY THE GOVERNING BODY. A majority
40 of the members appointed shall reside or own property in the downtown
41 development AUTHORITY district.
42 (2) The board shall be constituted as follows:
43 (a) (I) At least one member shall be a member of the governing
44 body, appointed to serve at the pleasure of the governing body; AND
45 (II) FOR ANY TWENTY-YEAR EXTENSION PERIOD PURSUANT TO
46 SECTION 31-25-807 (3)(a)(V), ONE MEMBER SHALL BE A MEMBER OF THE
47 BOARD OF COUNTY COMMISSIONERS OF THE COUNTY IN WHICH THE
48 AUTHORITY DISTRICT IS LOCATED, APPOINTED TO SERVE AT THE PLEASURE
49 OF THE BOARD OF COUNTY COMMISSIONERS. IF THE AUTHORITY DISTRICT
50 IS LOCATED IN MORE THAN ONE COUNTY, THE APPOINTMENT IS BY AN
51 AGREEMENT OF ALL THE COUNTIES IN WHICH THE AUTHORITY DISTRICT IS
52 LOCATED. IF THE APPOINTING COUNTY IS A CITY AND COUNTY, THE
53 REQUIREMENT FOR A COUNTY-APPOINTED BOARD MEMBER PURSUANT TO
54 THIS SUBSECTION (2)(a)(II) DOES NOT APPLY. IN ADDITION, ONE MEMBER
55 SHALL BE A MEMBER OF THE OF THE SCHOOL DISTRICT BOARD OF
1 EDUCATION OF THE SCHOOL DISTRICT IN WHICH THE AUTHORITY DISTRICT
2 IS LOCATED, APPOINTED TO SERVE AT THE PLEASURE OF THE SCHOOL
3 DISTRICT BOARD OF EDUCATION. IF A COUNTY OR SCHOOL DISTRICT DOES
4 NOT APPOINT A MEMBER OF THE BOARD, THEN THE COUNTY OR SCHOOL
5 DISTRICT APPOINTMENT REMAINS VACANT UNTIL THE APPLICABLE
6 APPOINTING AUTHORITY MAKES THE APPOINTMENT PURSUANT TO THIS
7 SUBSECTION (2)(a)(II).".
