After consideration on the merits, the Committee recommends that SB25-199 be amended
as follows, and as so amended, be referred to the Committee of the Whole with favorable
recommendation.
Amend printed bill, page 12, after line 12 insert:
"SECTION 15. Appropriation - adjustments to 2025 legislative
appropriation bill. (1) To implement this act, the total and general fund
appropriations made to the legislative department in Senate Bill 25-188 for the
2025-26 state fiscal year are decreased by $312,807 as follows:
(a) The total and general fund appropriations for use by the general
assembly are decreased by $62,424;
(b) The total and general fund appropriations for use by the legislative
council are decreased by $137,042, and the related FTE is decreased by 1.9
FTE; and
(c) The general fund appropriation for use by the committee on legal
services is decreased by $113,341, and the related FTE is decreased by 1.5
FTE.".

19 "SECTION 2. In Colorado Revised Statutes, 2-2-1303, amend
20 (2)(a)(III)(A) as follows:
21 2-2-1303. Membership - selection - terms.
22 (2) (a) Nonlegislative council members shall be appointed as follows:
23 (III) (A) On or before August 31 of each year, EXCEPT FOR
24 AUGUST 31, 2025, the council members shall approve subsequent
25 appointments to the council. A youth who meets the criteria set forth in
26 subsection (1) of this section may apply to the council to be considered
27 for participation in the council.
28 SECTION 3. In Colorado Revised Statutes, 2-2-1304, amend
29 (2)(b) and (4)(a) as follows:
30 2-2-1304. Duties - meetings - community outreach -
31 designation of organization to accept donations - authority to
32 contract - repeal. (2) (b) (I) The council shall meet at least four times
33 each year, with two meetings occurring during the regular legislative
34 session and two meetings occurring after the regular legislative session
35 has concluded. Council members may attend and participate in council
36 meetings remotely, but at least two of the council's meetings each year
37 must be held in person, with all attending members at the same physical
38 location. Additional meetings may be held at the discretion of council
39 leadership, subject to available money.
40 (II) (A) NOTWITHSTANDING SUBSECTION (2)(b)(I) OF THIS
41 SECTION, THE COUNCIL SHALL MEET ONLY ONCE AFTER THE 2025 REGULAR
42 LEGISLATIVE SESSION, IN JULY 2025, AND THE COUNCIL SHALL NOT MEET
43 AT ANY TIME IN THE 2026 CALENDAR YEAR.
44 (B) THIS SUBSECTION (2)(b)(II) IS REPEALED, EFFECTIVE JULY 1,
45 2027.
46 (4) (a) (I) On or before September 1, 2013, and every third
47 September 1 thereafter through September 1, 2019, the council shall, in
48 conjunction with the director of the legislative council, use a request for
49 proposal process to contract with and designate one or more nonprofit
50 organizations to provide staffing and operational assistance and to serve
51 as the custodian of money donated to the council through the designated
52 organization. The contractor selected following the 2019 request for
53 proposal process shall, pursuant to one or more contracts, provide such
54 staffing, operational, and custodian services through June 30, 2023.
55 Thereafter, the council shall, in conjunction with the director of the
1 legislative council, on or before April 30, 2023, and, except as otherwise
15 2 provided in this subsection (4)(a), on or before every second April
3 thereafter, use a request for proposal process to contract with and
4 designate one or more nonprofit organizations to provide such staffing,
5 operational, and custodian services. The term of each contract entered
6 into for a term commencing on or after July 1, 2023, is two state fiscal
7 years; except that any such contract may be extended for one additional
8 two-year term. If a contract is extended, the request for proposal for the
9 next contract must be issued on or before the April 15 immediately
10 preceding the expiration of the extension term. The designated
11 organization shall not be the custodian of any money appropriated by the
12 state and credited to the fund created in section 2-2-1306. The designated
13 organization is authorized to expend any money it receives as is necessary
14 for the operation of the council and may solicit and accept monetary and
15 in-kind gifts, grants, and donations used to further the council's duties and
16 responsibilities. Any money donated or awarded to the designated
17 organization for the benefit of the council is not subject to appropriation
18 by the general assembly. Any money obtained by the council or the
19 designated organization and THAT IS not in the fund AND that is
20 unexpended and unencumbered at the time the council is dissolved shall
21 be distributed according to appropriate federal and state laws governing
22 nonprofit organizations. If a different nonprofit or private organization is
23 subsequently designated as the custodian of donated money in accordance
24 with this paragraph (a) SUBSECTION (4)(a)(I), any money that is
25 unexpended and unencumbered at the time of the change in designation
26 shall be promptly transferred by the previously designated organization
27 to the newly designated organization.
28 (II) NOTWITHSTANDING SUBSECTION (4)(a)(I) OF THIS SECTION:
29 (A) THE COUNCIL AND DIRECTOR OF THE LEGISLATIVE COUNCIL
30 SHALL NEITHER CONTRACT WITH NOR DESIGNATE ONE OR MORE
31 NONPROFIT ORGANIZATIONS TO PROVIDE STAFFING, OPERATIONAL, AND
32 CUSTODIAN SERVICES FOR THE PERIOD BEGINNING ON JULY 1, 2025, AND
33 ENDING ON JUNE 30, 2027; AND
34 (B) THE CONTRACT THAT TERMINATES ON JULY 1, 2025, IS
35 EXTENDED FOR ONE MONTH TO ALLOW THE COUNCIL THE OPPORTUNITY TO
36 PRESENT ITS REPORT TO THE REVIEW COMMITTEE IN JULY 2025. THE
37 CONTRACT TERMINATES ON AUGUST 1, 2025.
38 (III) SUBSECTION (4)(a)(II) OF THIS SECTION AND THIS SUBSECTION
39 (4)(a)(III) ARE REPEALED, EFFECTIVE JULY 1, 2027.
40 SECTION 4. In Colorado Revised Statutes, 2-2-1305.5, add
41 (5)(c) and (6)(c) as follows:

43 advisory council review committee - created - repeal.
44 (5) (c) (I) NOTWITHSTANDING SUBSECTION (5)(a) OF THIS SECTION, THE
45 REVIEW COMMITTEE MAY MEET ONLY ONCE AFTER THE 2025 REGULAR
46 LEGISLATIVE SESSION, IN JULY 2025, TO HEAR THE REPORT OF THE
47 COUNCIL.
48 (II) NOTWITHSTANDING SUBSECTION (5)(a) OF THIS SECTION, THE
49 REVIEW COMMITTEE SHALL NOT MEET DURING THE 2026 INTERIM.
50 (III) THIS SUBSECTION (5)(c) IS REPEALED, EFFECTIVE JULY 1,
51 2027.
52 (6) (c) (I) NOTWITHSTANDING SUBSECTION (6)(a) OF THIS SECTION,
53 THE REVIEW COMMITTEE SHALL NOT RECOMMEND LEGISLATION DURING
54 THE 2025 OR 2026 INTERIM.

2 SECTION 5. In Colorado Revised Statutes, 25-1.5-111, amend
3 (2)(a)(XI) as follows:
